i've have just be re-assesed for esa i had to go through the medical ect i recived the results of the medical yesterday after 2 mouths and being place in the work related group to which i am appealing to read that the dwp's doctor said there would be no return to work for me within two years and the long term prognoise was that i would never be able to return to work again due to my illness i am 57 years old so it was a shock to fine i was placed in this group when i challange then about this and ask why i'd be put in the work related group and not the surport group which was clear to the group i should be in all they did was evade the question i asked who over rode there own doctors report i got no responce apart from appeal to which i'm doing but it seems to me that no matter how ill or disabled you are I.D.SMITH will do anything to take your benefits from even when there own doctor tells them your unable to return to work so good luck to all who are going through the same as i am i hope you win i will post my out come when i can also is there any help to fight back out there please let me know kind regards

Keep up the fight. The problem is that people making these decisions have no idea usually about medical conditions or how they affect people. When you appeal you can see who said what & why about you, this may reveal something you can use, to challenge or to correct.

See now I find this kind of thing totally bemusing how can they overturn their own medical examiners report????? it only goes to prove that the DWP have an agenda which has nothing to do with genuine claimants.
The cost of all the appeals they will have to deal with will be more than they will save.
Some one has to pay for the much deserved bonus of the CEO of RBS, poor fella.

I think the reason why all disability benefits are being looked into is because there's been a change in the way the government looks at disability and sickness. That's why doctor's now issue 'well notes' not 'sick notes'.
The Government is not interested in what your 'actual impairment' is as more than likely there is now an aid or an adaptation can remove that disabling barrier.
So what they really want to know is how does your impairment impact on you finding work so that they can supply aids or adaptations to get around it. This then effectively means you're fit for work.
For example.
Problem - 'I can't walk'
Solution - use a wheelchair
Problem - I can't type or your dyslexic
Solution - company to supply voice activation software
Problem - I can't navigate as I have no sense of direction
Solution - company to supply a hand held GPS phone
Problem - I get tired easily
Solution - Flexible working and work part-time
Problem - I've got a bad back
Solution - light duties and company supplies ergonomic chair to suit your needs
So as you see whatever the problem there is a possible solution as there have been advances in technology, aids and adaptations, legal protection laws and we no longer work in the mines!.
When companies recruit the main things they look for in a new recruit are their 'qualities' eg a positive attitude, flexibility, team player, enthusiastic, work on your own initiative. Working does have it's benefits if you want to work.

They are talking about the Medical Model of Disability, & not the proper one that I support, the Social Model of Disability.

I think the main thing employers are looking for are healthy people who are not going to be taking time off sick all the time.
No number of aids are going to get round that issue.
I , as I imagine many other "genuine claimants" would give anything to be well enough to get back into employment.

truth is many small companies can not afford to hire sick disabled people as much as many might want to, someone who might take extra time off you have to pay there sick pay and someone to replace them
if you had a small company would you risk taking on some with a record of ill health ?
