I am still in receipt of Incapacity Benefit long term and i assume that i would be entitled to the cold weather payment because i receive Incapacity Benefit.
Claimants who are now in receipt of ESA from Incapacity Benefit because they have been moved over do receive the cold weather payment.
Am i correct in saying that if you are disabled you are also entitled to the cold weather payment also.
I am in receipt of DLA and receive Incapacity Benefit as i have not been moved over as yet to ESA, can someone confirm if i am entitled to the cold weather payment please.:confused:

No being disabled doesn’t there for mean you will be entailed to receive the cold weather payment.
If you only receive DLA and IB and no other benefits then no you will not receive the cold weather payment as...
You have to receiving certain benefits to receive it....
Who can get Cold Weather Payments?
If you are in receipt of Pension Credit, Income Support, Income-based Jobseeker's Allowance or Income-related Employment and Support Allowance (ESA), you may also be able to get Cold Weather Payments.
Pension Credit
If you are in receipt of Pension Credit, you will usually receive Cold Weather Payments.
Income Support and Income-based Jobseeker's Allowance
If you are in receipt of Income Support or Income-based Jobseeker's Allowance, you will usually receive Cold Weather Payments if you also have any of following:
a disability or pensioner premium
a child who is disabled
Child Tax Credit that includes a disability or severe disability element
a child under five living with you
Income-related Employment and Support Allowance (ESA)
If you are in receipt of Income-related ESA, you will usually receive Cold Weather Payments if you also have any of the following:
the support or work-related component of ESA
a severe or enhanced disability premium
a pensioner premium
a child who is disabled
Child Tax Credit that includes a disability or severe disability element
a child under five living with you

Does seem a little di9scriminatory against disabled, I wonder if the Equality Act could cover discrimination because of being disabled and not being covered under these rules, so it's one of those odd questions.
