    Angry DLA APPEAL tribunal today, but no result!

    Hi, I was wondering if anyone could help. After many months of waiting I finally had my tribunal today.

    The lady before me was in there for 10 mins to which I was quite shocked at but she came out and went straight away.

    I was told before I went in that I would not get a result today, it would in fact be posted out to me this evening. So after a 45 min grilling and a rep from the DWP being present I left empty handed. No golden ticket. I was feeling rather unwell by the end of it and came out to sit down. The lady from the DWP then came over to me to see if I was ok. She then went on to say to me that if I was unsuccessful today, to which she does have no weight to the decision, that I should send in a new claim for straight away!

    Can anyone comment on this and maybe put my mind at ease?

    First breath, this is not a failure or the end. They can give a decision on the day, often they do not. You cannot read anything into this. They may feel they need to discuss, or check on a few things. I had to wait too, yet I felt they were on my side, that they agreed with me. I was right, I won. I got the letter saying I had.

    The fact this woman from the DWP said what she did is not a negative either. Seems like she was trying to show you the options. A new claim could be the way to go, even if you win, if your situation has worsened since this current claim was made, or if you do lose.

    Do you feel you told them all you could, in the claim & the appeal? Do you feel that the reason your claim was turned down was challenged properly by you are the appeal? At the end of the day we can only do our best. Most people win an appeal, because of stupidity I feel. That a claim was not looked at properly, that proof was not obtained to back up your claim, by DWP. So many reasons why claims fail, & they are usually because someone did not really look at it properly.

    See what happens, then you can decide your next steps, if needed.

    Hi Stephen,

    So after a few days of worry the brown envelope landed on the floor today.

    I WON!!!!! A unanimous decision LRM and MRC. I dont care thats it not the same rates, i just finally feel that ive been believed! The money will enable me to finally eat the foods i should be eating and help towards care.

    And to top it all off ive got it till 2014! Woooohooooooooooooo!!!!!!

    That is great news. I am pleased for you. Once it settles in you may feel your condition has changed, & would to make a new claim, if you do, remember to get help with it from someone like the CAB. Glad to help.
