    Appeal Hearing on 15th December/can i appeal decision

    Had a appeal hearing with regards a overpayment of housing benefit but was unable to attend due to ill health and i had no legal advise.
    Received a letter informing me that i had lost the appeal, can i appeal that decision, any advice would be great.

    I personally do not know. I would contact the CAB about this. It would depend on many factors too, if it were possible, as to why you lost the appeal. You could fill them in on your situation better than you can here.

    There are three things you can do, one is to write to the Tribunal service to ask for a full written statement of reasons as to why your appeal was rejected by the Tribunal. The full written statement is an detailed explanation from the Tribunal as to why your appeal was lost. With help you can then appeal further if you have grounds to do so. It is complicated which is why it is best to seek advice.

    Two is to also write to the Tribunal sevice asking for the decision to be set aside as you were too ill to attend. The Tribunal Chairman may then decide that your appeal should be reheard giving you the chance to attend and give evidence.

    Duncan? I do not understand how an appeal can happen without the person either attending or being made aware it is happening without them. It seems to me that would be wrong for the obvious reasons.

    Some people just do not bother to turn up to their appeal and the Tribunal go ahead and make a decision based on the papers in front of them.

    you need expert advise i think you can only appeal on a point of law ...... not the fact you where ill unless you can get i think its a set aside (not sure if name correct)

    CAB or some other welfare unit is needed ASAP

    Yes, true |Dave, but if someone is sick does that not mean it should be rearranged?

    I think they would if he telephoned and told them he was sick ..but we dont know what steps where taken
