    Unhappy Dla Refused Esa medical?

    Just got word yesterday my dla claim was refused not happy at all considering i spend last saturday at a+e after my leg locked and i fell then to top it all i got my medical appointment for esa on 29th feb i could cry i really could i just feel like giving up where do i go from here

    hi fizzy it would seem we are both in the same boat as yesterday i also got my dla refused so we must of had the same decision maker who must of been having a good day of dismissing peoples claims.

    when you got the decision did they disregard and go against the statements you made in the forms you sent as this is what happened to me.

    it was like they were making wild guesses and presumptions not good though when it results in loss of claim.

    any way i know i am now not alone.

    one thing to do which i know is hard at the moment is either ask for a reconsideration or take it straight to appeals. formally ask to see any paper they hold on you, ask for full written reasons for declining your dla and most important ask for a gl24 form this is so you can appeal.

    if you ask for reconsideration this will give you some time to go through their decision with a fine tooth comb and give you a chance of drafting out the appeal form. on the appeal make sure you ask for oral hearing and try and get someone to go if they wont over turn the decision of consideration.

    it is not a good situation and can only feel for you,

    Yes, & talk to someone like the CAB to help with an appeal. They are use to doing this sort of things.

    Makes you feel so low and i have been sitting thinking is it worth it whats the point
    it said if i didnt agree to ring and state why it said it was based on my form and medical evidence

    best bet is appeal that means they will give your case to another DM to review you have about a 50% chance of an award at that stage too you can download appeal form

    Another thing is i havent had my rheumtolghy appointment yet it went in as urgent i dont know if an actual diganois from them instead of gp would help things

    (sorry for spellling i cant get spell check to work)

    fizzy i felt like you in that i thought is it worth it but after the letter sent to me in which my disabilities and care will no longer exist in may even though my condition is of a permanent natures, this is enough for me to fight these people even if it is to clear my name.

    as for any evidence the more you have the better in the long run.

    diaganois is not that important its your needs, many people get dla years before they know the exact cause and give it a name

    Breath Fizz. Do not see it as a mountain, but one step at a time, & that is where someone like the CAB come in.

    Dave is right, but so is Mikey. I have not had everything diagnosed, but some of it has. You list all you know, what you have, how it affects you, the names of anything. They then check on this. I am sure I have ME or something like it, but they have said no as they said I said I have no pain. Why am I on two pain drugs then? Why have I been to the Pain Management Clinic several times? This all helps, that I have said I have certain symptoms, am on drugs, been to this place & that place, etc. I have other conditions too. So it all helps.

    It is how these things affect you that really matters. Even with a diagnosis people are effected differently.
