    Had my appeal yesterday just waiting for my decision

    I had my appeal hearing yesterday at 2pm, i did have a presenting officer turn up from the dwp, she was late so didn't get in there until about 2.15pm I was extremely upset throughout and answerd questions as best as I could and honestly the panel was very kind to me asked if I wanted a break, which I declined and told them I would rather continue to get it over and done with, the presenting office for dwp got a telling off from the judge at the beginning because the dwp did not disclose that I had been on Lc and Lm on dla beforehand and had an indefinite award, and couldn't understand how the conclusion had been made that I received 0 points on the transfer to pip, he told her to make a note that this information should have been forthcoming and to make sure it didn't happen again, the presenting office asked me two questions which I had already covered while the doctor was talking to me, and had nothing else to say I did expect a grilling off her but she sat through it not giving any argument of why I'd received 0points and basically stared at me throughout, the judge allowed my dad to speak at the end and the disability specialist thanked me for the extremely useful evidence I provided making a point of saying my mom and dads letters of support was very helpful in reference of day to day life, I got out at 3:40pm and was told I'll receive my decision in the post Tuesday morning, the presenting officer from the dwp couldn't get out the room quick enough, by the time I had picked up my belongings she was nowhere to be seen, as promised by the tribunal service the clerk came out gave my dad the expenses form for the taxi and then rung me a taxi and told me it was covered by their account, and to sit down, he then looked at me and said now breathe which I thought to be extremely considerate of him, it's just a case of waiting now to see what the outcome is.

    Of course nobody can say for sure, but it sounds promising for you.

    I would have loved to have been there to see the judge ripping into the DWP rep.
    I'm intelligent enough to know that I don't know everything.
    But I'm good at searching for, and finding, stuff.

    I'm a pessimist, so I'm naturally thinking I've not got any award, but I am glad that the judge did tell the dwp rep off, because it's about time that they are made feel as stupid as we are made feel by the dwp

    I was talking to someone today and he had the same thing with DWP at his appeal.The judge wiped the floor with them and they went out with their tail between their legs.My friend told DWP that if he did'nt win the appeal and get PIP he would take them to the European courts.He did win he got a total refund for the months he had had his money stopped and in the award letter he was told that he would never be contacted again because he will never get any better just worse.So even though it was a long hard slog for him and he didn't give up he won in the end.

    Tribunal judges are getting fed up with having to do the DWP's job for them; mainly because the DWP keep trying to interpret the law wrongly to suit their own purposes.

    Maybe all awards should be made by an independant tribunal - and cut the DWPs own Decision Makers out altogether?

    Hello nukecad

    i rather like your suggestion of all awards being made by an independent tribunal, a much fairer system, all be it more expensive.

    Although I wonder, what with paying the assessment provider, Decision Maker's and the process of going to a tribunal, is it that much more expensive?

    Now that is a thought, good one at that, and it would possibly be more cost effective than the present procedure.

    Sounds good! well done for getting through your appeal it must have been nerve racking, hope you get a good outcome

    I'll be honest I sat crying like a baby throughout most of it, as I suffer with mental health conditions, but I did the best I could, i said to my dad after that I thought it had gone badly, but my dad thinks the opposite and thought it went well, as soon as the clerk told me someone from the dwp was going to be there, I broke down in tears and had a massive panic attack and told my dad I could do it, he was the voice of reason and basically said get yourself in there and let them see what you face everyday, I'm glad he did because if nothing else I know that they couldn't deny my anxiety even though the Hcp did
