    I completely agree with your above statement, however, as I understand it, ATOS Healthcare are the subcontracted by the DWP to make assessments on this behalf. It is like you going to a garage to get your car fixed and they send away a part for repair to a specialist. If the part fails during its period or guarantee, then the seller, i.e. the garage are responsible for the work done and therefore responsible for sorting it out.

    Ultimately, it is not fair that the DWP get prosecuted for the behaviour of ATOS, however, they have a choice I believe to use them or not and if they don't they would I guess they would cease to exist. That as far as I am concerned would be the best result. There are people whose livelihoods depend on ATOS. I don't know I feel about that. I do know though that people have committed suicide because of the way they were treated or the trauma they put them through and ATOS still smells of roses albeit fertilized with horse manure…

    No DWP are the 'Data Controller', the assessment providers (Atos et-al) are 'Data Processors' for the DWP, it makes a big difference in law.

    When working for GP surgeries, etc. they will be 'Data Processors' for the NHS. The NHS will be the 'Data Controller'.

    By law any 'sets' of data for different Data Controllers must be kept seperate by the Data Processors, so the assessors could not pass NHS data to the DWP, or vice-versa.

    (The NHS/DWP as Data Controllers may be able to pass data to each other, but only with your permission).
