    tribunrals

    hi im new to this but need advise my husband had to have a iuc 2 years ago then dla mobility got stopped went to tribunral they want to look at medical records dateing back 14 yrs we have realsed them and awaiting a new date they say my husband is not has ill as we stated back in 94 on claim form this is untrue we have doctor support letter ot assesment ect but its got to the stage where we would rather pay 1000 dla want back then suffer any longer well we have been told that the tribunral could still take the case back to 94 no one seems to give us any ansews has this happened to anyone else or similar or is there ant advice

    You should get help from a Welfare rights adviser in your area. You would need upto date medical reports on your husband from Consultants as well as your GP. Your GP should have copies of any Consultants reports in your husbands medical file.

    Your GP is within his/her rights to charge you a nominal fee for any copies of medical records, but by the sounds of it will be well worth your while

    thank you we do have medical notes but the first tribunral said they are looking at the claim now all the way back to 94 dwp are saying they think my husband is not as bad as he stated they have two vidios of him as well one walking ok on a good dat one bad day he hasnt seen a consulant in years but we have ot assesment doctor report welfare rights says its 50/50 its been 2 half years os stress we donteven want the money back now if we withdraw they can still take it back

    hi shaz, i feel for you we are going through the same thing ours has been going on for about 3 years and we were so close to suicide throught the stress, then we had a letter saying they had no evidence so that was it but we still have to go to appeal to get his money back ,i can honestly say this has been the worst experience of my life ,they treat you terrible in the interviews asking the same question over and over again trying to trip you up but as we were telling the truth thay could not do this, iam dreading the appeal which is for 4th march did you take anyone with you because iam waiting for a spine operation and taking morphine and i was going to be the person who speaks for hubby as he cannot do it himself, but i cannot think straight when iam taking morphine. good luck

    The fact you are taking morphine sadly has no bearing on DLA. I have been taking 30mgs twice a day for the past 7 years. Altogether I take 174 tablets a week and am under 40.

    Have you been taking MST for long, you will get used to it, what dose are you taking ? Do you take MST or oramorph or do you have oramorph for breakthrough pain

    Sorry, that sounds like 20 questions doesn't it ;-) Just interested in speaking to someone else who takes MST, as I don't know anyone else who takes it daily

    we had a welfare officer now we have a solictor she thinks its 50/50 if they take it back to 94 thats thousands its a nightmare i would not worry the tribunral will not be that bad for you as they have no evidence the people on the panel are no way as bad as a fraud investigator they will be looking at your husbands needs again my husband takes salpdol the srongest its the only think that dont make him ill they have even said that thats not good enough for someone with his spinal problems the doctor has said thats rubish the thing is he has never been sent anywhere for years he just got on with his condition thinking that this is how it is took each day as it come nothing you do is right its living hell

    andypandy i take 147 tablets a week and yes it is oromorph i take it is suposed to be taken every 2-4 hours for breakthrough pain ,but the painkillers do not seem to work so iam taking it more each day but people and doctors do realise how it makes you feel (unless thats just me) iam taking 20 mil each time and after i just feel like iam on a different planet it makes me feel light headed and sick and it only gets rid of the pain for a short time, iam really worried as iam waiting for the phone call for my second spine op in 2 years ,if iam already used to oromorph how much will they have to give me to cope with the pain of surgery.
