    Feel like i have been waiting forever and now/what now.

    Well finally got a decision today, i am very depressed after waiting with such anticipation, below is what has been said.

    Dear Mr Ryan
    This Letter is about your claim for Disability living allowance.
    Disability living allowance is made up of two components, mobility for help with getting around and care for help with your personal care.

    MOBILITY

    I have not awarded you either rate from and including 09/03/2012.

    Care

    i have not awarded you any Rate from and including 09/03/2012.

    Although you have walking Difficulties, and you need help with personal care, to be entitled to disability living allowance you must be expected to satisfy the disability conditions for at least six months from 12/05/2012. your needs are likely to reduce so you will not satisfy the disability conditions on 18/11/2012. Therefore, you are not entitled to mobility and care from and including 09/03/2012..

    So there you have it, even though i do need this help i am not to get it, i feel so so bad, i have been under doctor for T2 for few years not months, i had my first heart attack and first stroke eleven years ago, i am getting worse with ny walking, yet apparently i am not in need of help.

    What am i to do now, i cannot even afford to get to the Anticoagulant clinic every week, if it falls on the same day as doctors it costs nearly £20 by Taxi, i have been in touch with "Dial a ride and they say i will be picked up 2hrs before hospital and have to wait for two hours to be taken home, i cannot take this, i do not deserve this.
    Please tell me what my next step is, i have no information in the head i find it hard to hold onto information in the head, i do not want to live like this, i wanted to get out, get a train to see my Grandchildren, but i cannot, no i do not want this.

    you appeal the none award then someone will look again someone different if they dont change the award it goes to appeal

    to get dla mobility higher rate they are looking at someone who cant walk even a couple of steps without pain


    the guide book used to make a mobility decsion says
    are unable or virtually unable to walk because of a physical disability1 (see DMG 61276 et seq) or
    2.
    are severely visually impaired and satisfy the conditions2 in DMG 61334 61339 or
    3.
    if 2. does not apply, then are both deaf and blind and satisfy the conditions3 in DMG 61340 -61348 or
    4.
    are severely mentally impaired4 and
    4.1 display severe behavioural problems5 and
    4.2 satisfy the conditions for the highest rate of the DLA care component at DMG 610616 (see DMG 61350 - 61380) or
    5.
    have had both legs amputated either through or above the ankle7 (see DMG 61332) or
    6.
    are for any reason without both legs to the same extent as if they had been

    As the above reply implies, the DWP do not care about what your health condition is.

    You must state how it affects you as everyone is different.

    They probably assumed that as most people with these conditions do not have any long-term problems (lasting longer than 6 months) then you were not entitled to DLA.

    Just been in touch with DLA and been informed that they " although it says they had advise from a Health care professional in the letter" they never in fact contacted anyone at all, so they have lied on the letter they have sent me.
    They are now sending me an Appeal form so i can write down my grievances of what i do not agree with, and one is the fact that they have lied on the letter and spoke to nobody even though they said they gained information from Health care professional, so who are they to "Assume" i will be ok by the date they have said.

    Hi Paul, i have been told that my Angina will not get better, that the Asthma that i have had for 60yrs will not get better, the effects on my legs from three strokes will not get any better, and that the effects that the T2 Diabetes is having on my walking and health in general will not get any better, and as said they have not contacted anyone concerning my conditions, again, who are they to assume anything at all.

    Bit confused , that seems an odd thing for them to say.
    I assumed that when they say they have had information from a health care professional they are refering to an ATOS person who would have assessed your claim initially before passing it on to DLA. If it is a lie it may be a huge confession of bad practice but I'm not sure that would win you extra points with regard to your claim, I may well be wrong and someone here will correct me.
    Anyway, that doesn't affect your right to appeal their decision for refusing your claim.

    the DM at the DWP has access to drs and thats where in most cases advice comes from look at a to z medical conditions dwp

    this shows problems they expect you to have you would imo need a lot of damage to heart and damage by strokes to need help


    the fact your still alive 11 years after stroke is against you they expect "serious" ones bed bound or dead 20% within months

    Thanks Wobble, well whilst on the Phone i asked then openly who the "Health care professional was" that they refer to in the letter, i was told "i don't know why you have been told that in a letter because the department has been in touch with nobody, according to your records Mr Ryan.
    So again who are these people to assume they know anything about my conditions at all and how they effect me, they are bad people, those that make the decision are not professional at all, if they were then why would they Lie to me, and if they have lied so openly they will have lied to thousands.

    But my strokes affect me, each time they have happened on the same side, each time a bit worse, this time i am left needing to walk with a stick, and because of the weight on the one side the pain is very bad because of the weakness on that side, therefore i find it difficult to walk to shops, i do not go until my son finishes work at eleven at night and comes to take me Tesco, Just as my Diabetes affects me also, i have horrible feelings in my legs, strong Pins and needles when i cough that run through them and cause me pain, i cannot walk meters without having to stop for breath because of the joint effects of every condition, i am a High risk patient for heart disease they have not contacted my doctor, there for they are playing god, how would they know me better than my own doctor of 20yrs, they would know nothing without speaking to him.

    I cannot afford to go to the Hospital every week like i have been doing, i was given ambulance services number to arrange maybe help with being picked up, i have rang numerous times only to get message "Please leave number and someone will ring back" they never do, i cannot afford the £5 pound to get there then the same to come home, if it falls on same day as docs then it costs me 20 a day, i get incapacity benefit, that's it plus a couple of pounds income support without that i would have to pay for prescriptions, yes i am very depressed, all i want is some kind of life back before it is all to late.
    In doors i use a Frame for walking because i have started to stumble the other way now also, but to read in the letter that they feel i will be better by six months is so patronizing, i know how i feel, my doctor knows how i am affected, yes i am very depressed.
