    Angry ESA - disabled & pregnant and my claim being denied

    i received word today that my claim for ESA is being denied.

    i have been on ESA Since August 2011, and have recently had my second medial exam which i apparently failed, i am suffering with severe back problems due to prolasped disc and worn disc and need to use crutches to get around, i have been waiting for over a year now to get injections into my lower back to freeze the actual nerves but have not received them as of yet

    i am constantly in pain, i also have other problems that have been caused with the problem from my back as disc has damaged some of the nerves -i also suffer sciatica, weak bladder (attending urology) and depression.

    For the above I was taking an extreme amount of medication, which has also left me that i am unable to sleep at night which is caused by the side affects of meds and the pain.

    I received a form which i filled in form and posted, then received appointment for medical exam, between receiving appointment date and actual appointment i found out that i was pregnant. My doctor then advised me that i would needed to stop all medication until i seen my consultant and he would advise what meds i can take. I told the medical examiner all this information and what way i have been affected as i am now not on meds, my own doctor had advised me that my condition may get worse as i am not able to take my medication that i need and as my baby gets bigger so will my problems

    I am so confused and stressing out here, at this stage of my pregnancy i honestly do not need to be stressing over ESA and need your advice on what i need to do, i do plan to appeal and if anyone has any advise/help they can give me i would be very grateful

    you need to appeal stright away for that you will need new sick/fit note from your GP get form here................

    http://www.dwp.gov.uk/docs/gl24dwp.pdf this will cause a review by another DM if they will not change there mind it will then go to appeal


    first question they are going to ask you at appeal if they argue your case is how if in constant pain did you get pregnant?

    you need to get expert advice cab or some other welfare group

    I would think your GP would confirm that the pregnancy is only going to aggrevate your back problems.
    By time your appeal is going through it may well be that ESA applies due to your pegnancy, assuming that you are not entitled to MA depending on your previous work and NI contributions.

    the appeal can i think deal with her condtion at the time of the award when it was refused....the good point you bring up is she soon might be able to put another claim in due to the postion of now expectingdepending on ni contributions
