    Help

    Hi

    I've been on DLA Mobility Component Higher rate since 1991, was awarded lifetime so haven't needed a medical or anything since. I didn't know i could also receive Care Component until a few days ago.

    Since my accident i've needed help washing/dressing and can't do any cooking because of my disability and need someone to keep an eye on me when walking. How do i go about claiming for Care Component? Do i just get a form and fill in the Care Component section and ignore the Mobility Component section as i already get that? i'm a bit confused. I have missed out on alot of money over the year's that i was entitled too (do they backdate it lol).

    Any advice?

    YOU Need to get advice because when you apply for care they can review your mobility and you could lose it.

    I had mobility for life higher rate for years before I applied for care I applied for care and in the mobility section in each box I wrote

    " No change in mobility please just review care needs"

    That said if anything you write in the care section brings into question your mobility needs they can review it and ask more questions or send you for a medical.

    They do NOT back date it only from the time you applied I went from higher mobility indef to higher mobility inder middle care indef without a medical

    get help from CAB or someone like them

    Same here got dla in 92 (mob high) and have applied dla care part
    And what I did was phone dla report a change of circumstances
    (just last week) and they sent out a claim pack and to fill in the
    Care part of form .The form is dated on the day you phone so will
    Only be back dated to then and has a time limit to send it back
    I phoned on 31/7/12 and to send back by 23/08/12

    You definitely need help with this. Although the mobility part of the form wouldn't need to be filled in, the care part will need to be very carefully worded. I'm concerned because you say that you need supervision when walking. Part of the Care questions concern mobility indoors - it could be all too easy to give the impression that 'supervision' is all that is needed, and they could then look at your Mobility component as well.
    Just bear in mind that for High Rate Mobility the criteria are things like pain, severe discomfort, breathlessness, limitation in speed, manner of walking, and the need for support outdoors. In other words physical things. Supervision alone can only warrant low rate mobility.

    Hi all

    Many thanks for all the replies...

    The reason i get Higher rate Mobility is because i'm an incomplete paraplegic and have major problems walking, virtually no feeling/movement in left leg so tend to drag it and it can make me trip/fall. Can't stay sat down for long as i also have a curvature of the spine and suffer with severe pain in my back and right leg and walk very slowly using crutches + other problems.

    I could leave out mentioning the ''supervision when walking'' and just say i need help washing/dressing and can't do any cooking because of my disability. It does concern me that if i apply for care component they will look at/try and take my mobility away (they're screwing us all over any chance they get nowadays ). The fact i haven't needed a medical for DLA since 1991 might also go against me and they will call me in for an assessment for Care & Mobility with one of those fake Atos Doctors who will lie and say i don't need either.

    I recently had my Atos face to face assessment to see if i qualified for ESA support group but of course the Atos so called Doctor found me fit for work lol (scored 6 points for the sitting/standing question) i have appealed as i've seen my ESA85 medical report form and it's a pack of lies but i've lost my Incapacity Benefit since 26th July.

    I could always wait til they scrap DLA for PIP and then say i need help ''washing/dressing and can't do any cooking'' but i will have lost out on alot of money... not sure what to do for the best.

    I think this is more relevant. I would concentrate on your appeal. DLA are part of the DWP and will have access to your ESA85.
    Are you saying that you are not even in wrag group? If you have appealled then you should still be getting benefit whilst your appeal is being dealt with.

    Hey

    Nope, not in Wrag Group. Had a phone call beginning of July saying i hadn't got the 15+ points to qualify for ESA so i would need to apply for JSA as my IB was being stopped July 26th. The person said i can appeal the decision as long as i got a sicknote (which i have done) and i would be able to get £71 per week (should get first payment 8th Aug) while my case is being reviewed, i'm losing £40 per week.

    A few days ago i phoned DWP and asked for the ESA85 Medical report and all other info like The ESA85 Decision Makers Scoresheet, Copies of all the medical evidence the HCP used and copies of all the medical evidence the Decision Makers Office used.

    On another forum people said i shouldn't of even had to go to a face to face Atos assessment as my condition is Paraplegia which is in the number 1 category for ''Unsuitable for calling to a Medical Examination Centre'' list I phoned DWP and told them this info but they fobbed me off but i will bring this evidence up in any tribunal i have to attend.

    I was very niave when i filled in my ESA50 form and also went to my Atos medical (wish i had searched the net so i was clued up on how they opperate).

    The Mobilising unaided question i thought would get me 15 points but was really shocked i received 0. I use crutches to walk and can only walk short distances (very slowly) and have to stop frequently to rest. After seeing the Dispatches programme the other night and that woman saying if a person has good hands then they can use a wheelchair to mobilise more than 200 metres so they get 0 points, what a joke… if that's the case and people have to use wheelchairs then we should receive 9 points for the not being able to go up & down 2 steps question (they can't have it both ways to give 0 points). Why don't they ask at the assessment if people could mobilise 200+ metres in a wheelchair (they don't have to be sneaky about questions) I would of explained to them it's easier for me to be upright and walking with crutches to move around as sitting causes me much more pain than standing. If i was in a wheelchair then i would need to stop and stand frequently as my back would be in severe pain and i would need my crutches but how do you carry them in a wheelchair?. I got 6 points for the sitting/standing question.

    I have appealed the Atos lies on 4 decisions as some of the questions weren't fully explained, some not even asked at all (meaning 0 points) even though i wrote on the ESA 50 form all the problems i had but i'm waiting for a response.

    I'm sure in a few years time there will be a big inquiry into Atos & the current governments treatment of Disabled people but at the moment we all have to suffer

    I forgot to ask this question...

    Is it true that Atos can find you fit for work but when you try to sign on for Jobseekers Allowance they can refuse because you're not fit enough for work? so you end up with no money at all?

    Yes that is very sadly true, although someone here did recentely say that JC are instructed not to refuse ESA failed applicants. I have no idea if that is true but there is certainly a conflict of criteria within the DWP.
