    Housing benefit

    I recieve middle rate care DLA, my daughter is 11 and recieves higher rate DLA care. I am moving to a new area and I cannot understand how much housing benefit I will get. I am moving before April when I understand the rules change.

    My problem is that I need a 5 bed house, one room each for me, my sister and my three girls. I think that the youngest two girls are expected to share but my youngest child is severely autistic and cannot share under any circumstances. Is it correct that we will only get a 4 bed allowance? To make matters more complicated, I cannot find a 5 bed but can find a 4 bed where the main bedroom is very big and I could share with the older girl. The cost is much more than is allowed for a 4 bed but would be covered by the 5 bed allowance.

    If the Housing Benefit Office decides that your rent or the size of accommadation is unreasonable, it must consider whether you are in a "protected group". This means disabled/sick.

    Your rent cannot be restricted unless the Housing Benefit office can show there is cheaper suitable alternative accommadation for you to move in to and that it is reasonable to expect you to move.

    A council still at this time have a duty of care, and if they carry out an assessment and decide you need a five bedroom house then they will find one, sadly in my area it has a real shortage, people are moved out once a person leaves home or your able to live in a three bedroom.

    The rent well in my area the difference between a four bedroom and a five bed room is thirty quid, but since most people get housing benefits it does not really matter.
