Personal Capability Assessment - complaints procedure REVEALED

The document contains a very useful set of ‘complaints codes’ which provide you with a comprehensive list of possible grounds for complaint.

Today I was informed after writing numerous letters that twenty labour MP's are demanding that the WCA be ended and the old PCA be brought back in, one of the people is Ed Miliband, but sadly I think this is more to do with him trying to win the next election then actually do something for the disabled and sick.

But only twenty Labour MP's thats bloody shocking

I found the article below, when I decided to look into this firther. We all know there are people who lie, to get something for nothing. What I find worrying about this doctor is it seems there is an assumption. I can see in the case of the man mentioned that he may have been dishonest. However, I have hands that are callused, I have borken finger nails, I have a tan (Though mine is natural, lol). I can empty a bin, I cannot drive though. What is this assumption that if you are disabled you cannot do anything, or you are not allowed to do anything? A lot of disabled people cannot do certain things. Are we saying that a disabled person cannot go on holiday, or sit in the sun? Are we not suppose to perform household chores? We may not be able to to everything, but often there is something we can do.

Yes, the man mentioned could have had hands that showed he may do manual work, as in a job, but my hands could be seen that way. I have burns & cuts, scars & damage. Why? Form trying to do simple things. Trying to balance as I walk, leaning on things for support, putting my hands on things to stop me falling over. Burning myself on the over of a pan, or a hot dish from the oven. Cutting myself trying to chop food up. If I was before him would I be seen as a conman? Would he think I had a tan, or a job in a kitchen? I use to be a chef. Would he think i did manual work?

Perhaps this doctor is one who ends up seeing more fakers than genuine people, is that possible? Perhaps he has seen a few cheaters & this has clouded his judgment. What I do know is that many in society think we are all faking. That whenever I speak to an offical, be that someone from benefits, Housing, Council, etc, it is more a case of I have to explain myself, I have to defend myself. They may not be say it, but the onus is on me to prove who I am.

So, for example, if you believe that you are exempt from the personal capability assessment but you are sent an IB50 questionnaire and/or called to a medical, it appears that you can make a formal complaint to Atos about this on the grounds that their initial scrutiny process has not been adequate.

I found it easier to phone up my IB office and complain to them when I recieved an appointment for a medical earlier this year.

I asked them if they took into concidereation the fact that I'd previously won appeals at a Tribuneral and using the GL24.
I told them that I felt that I was exempt from having a medical under the"Progressive impairment of cardio-respiratory function which severely and persistently limits effort tolerance" rule.
And, I also asked them if The DWP and ATOS would accept liability if I was found by them to be fit for work against the better judgement of my specialist and anything happened to me?

The next day I recieved a letter from ATOS cancelling my medical due to "unforseen circumstances."

Unforeseen circumstances, I like that. They never admit they are wrong.
