    Overpayment Recovery

    I recently won my appeal against a decision not to allow my claim for Employment & Support Allowance. I received a letter on April 1st stating that I was due some arrears, but these were being held back due to some overpayment of Jobseekers allowance some 13 years ago I got in touch with the Recovery Department of the DWP who told me that the overpayment of JSA could not be taken from my ESA claim. I am therefor wondering if anyone could tell me if this is correct.

    No over payment or even bank charges can be taken from a means tested benefit that is the law

    Theres a leaflet on this site which explains and a free phone number for more info. Scroll down to page 3 and look in the bottom right corner for time limits on collecting Social Security overpayments.
