    Incapacity Benefit Medical.

    My incapacity benefit was due to be reviewed on 26th Aug. But I've heard nothing. Is it because they are very busy? Or is it because they are holding it back until March/April next year so they can reassess it under ESA rules. Someone told me that is what they are doing. Any help appreciated.

    The delay is almost certainly simply due to the increasing caseload of new claims on top of the existing case load so it is not uncommon for there to be a long delay between the due date for review and one's claim actually being reviewed the first stage of which would normally be sending you an IB50 to complete which would then be considered before either renewing the claim until you are due for migration or calling you in for a medical under the existing PCA.

    The net effect of this is that yes some people who are due for reveiw of IB before they are due for migration might well be being held back as it would be a waste of time and money to duplicate the assessment process. Whether or not that will be the case for you is impossible to tell as there are still many people being re-assessed for IB even now and who will then either be migrated without a fresh medical or subjected to the WCA as and when they are part of that process.

    The earliest that could happen, unless you are in one of the two pilot areas, is April next year and probably long after that given the huge case load which will need to be migrated between next April and 2013/14 under the cuirrent plans and with the new Universal Credit possibly replacing ESA before that even happens.

    Sorry for such a long reply but sadly it is this very complexity that makes simple yes/no answers pretty well impossible.

    The date you are given is a review date, during review you may or may not be contacted, or as Peter says there may just be a delay. As long as you are still being paid there is no problem.

    You could always ring them if you were worried Sue but I am sure if they really wanted to see you they would have been in contact with you.
