    DLA rates from June 09 ( backdated awards )

    Can anyone confirm these amounts for me.

    MRC £47.10 per week from April 2009 until April 2010 and then increased to £47.80.

    What day in April did the change take place ?

    Was any other bonus for MRC DLA given in that time apart from the £10 xmas bonus ?

    How do the DWP caculate DLA back pay ( per day / week ) ?

    Finally does the back pay start on the exact day the DLA application was dated ?

    Yes the claim starts from the date on your claim form, so if you won a appeal then your money should be backdated to when the claim was stamped by the department.

    Josephine is correct about the back dating in the case of successful appeals the award will run from the date the original application for the benefit was received by the DWP.

    It is also worth bearing in mind that middle rate care might also entitle you to the severe disability premium on means tested benefits but this will depend on your precise circumstances and getting this element of your benefits backdated can be problematic unless you were already in receipt of means tested benefits at that time.

    Main thing is to raise this question with the benefits people to make sure they have taken the possibility of changes to your eligability to means tested benefits into account based on the revised award of DLA and if any problems arise let us know and we will try and help sort things out for you.

    The DWP got the start date wrong by 6 days. So they will need to be contacted about that.

    I dont think they qualify for that because they have a partner and a CA Claim in process.

    Our pleasure Jen and please pass on my best to them and hope they get their net access back soon. I'm lost without mine. LOL

    On the start date for the claim I suspect they have fallen foul of the way benefit weeks are worked out with claims starting from the start of the next benefit week involved but in most cases I have been able to argue successfully that the date stamped on the claim form is not when the DWP actually received the claim but just the date it reached the relevant department and on that basis they have agreed to allow the extra day or so involved ensuring the claimant doesn't miss out on a complete week of benefits simply because of their internal mail system.

    That's what I thought. They have a date stamp on the DLA application form which the tribunal award also states as a start date. Its just the DWP who removed 6 days . I blame the DWP forward thinking calculator made by Sir Clive Sinclair.

    Strange you should say that you, my backdated award should of been payed from the 10th and instead they payed me from the 16 which means i have lost out on a week pay as a result.
    I shall ring them today asking them what they are playing at when i won a appeal and it clearly states award starts from the 10th and not the 16, will keep you posted.

    Hate to be a conspiracy theorist but it is amazing how many claims miss the start of the next benefit week by that single day. LOL

    As I explained earlier this is often also down to the start date being the date stamped on a claim rather than the actual date the DWP got the original claim and only dated it on arrival in the dept that stamps them if that makes sense.

    If this is the case one can argue for the start date to be shifted but its hard work to get them to agree but that said it can be done cos I have done it as they say. LOL

    Hope that clarifies why yes it is possible to lose up to 6 days benefit because the claim starts from the start of the next benefit week if that makes sense.

    Have you had any feedback from the DWP regarding this. There appears to be several of these questions on various forums.
