If the Professor has had a review of the system for Work Capability Assessment then does that mean that anyone sent the forms to fill in will receive the new reviewed forms with the changes in place.
I was called in for a medical but never received any forms to fill in or a reminder but would we receive a fair assessment under the Professor review.
Should everone who is due to be called in for a review, get the new reviewed forms and then if they dont receive enough points to be classed as unfit for work be called in for the medical.
Would Professor new review benefit people and make the system fairer.
I never went for my medical because i never received the forms to fill in, when i rang and asked why i had not received the forms, was told that they had been sent out but they would use the old forms from 08 to refer to, with asking me questions, that s not the correct way, there not following there rules that are in place.
They sent me a form asking me to fill it out asking why i never attended the medical and for me to return it to them and they would then decide but if they have not followed there own rules how can they say i am not entitled to benefit anymore.
I could say if they say i am no longer entitled to Incapacity Benefit because i never attended the medical but would the rules not state that if you have not received the forms and completed them, how can you be called in for a medical and how can that be fair.
Josephine the DWP did follow the rules, they sent you an IB50 to fill in & they would also have sent you a reminder, when this was not returned by you for the reasons you have stated, this would have triggered a medical assessment based on the lastest info that they have for you, which is the last IB50 you gave them. The DWP use rules, regulations & the law, they have procedures that they follow & this is what they have done in your case.At every point in your claim, there are processes that the DWP carry out,for instance you did not attend the medical & this has triggered a letter asking you to explain your failure to go to the medical.
You did not attend the medical & this has put your benefit at risk, you should seek advice as soon as possible from the CAB or a Welfare Rights Officer.
The CAB for your area:

Never received the forms or a reminder and i did ring and inform them of this, when i received the letter with regards the medical but was told to attend anyway.
I did not attend as i had flu and i returned the form explaining this and telling them that i would be prepared to attend another medical as to whether or not they will send the forms for me to fill in, i dont know.
