    am i fortunate

    hi,
    I HAVE BEEN RECIEVING INCAPACITY BENEFIT AFTER SUSTAINING MULTIPLE INJURIES SOME YEARS AGO AFTER BEING RUN DOWN WHILE OUT CYCLING , I HAVE READ AS MUCH AS I HAVE SEEN ABOUT THE NEW CHANGES THAT ARE HAPPENING TO BENEFITS ETC , MY QUESTION IS I REACH THE STATE 65 RETIREMENT AGE IN EARLY MARCH 2014 DOES THIS MEAN THAT I AM FORTUNATE TO FALL IN A CATERGORY WHERE I WILL NOT BE SENT FOR ANY INTERVIEW OR MEDICAL ?, OR DOES IT MEAN I WILL NOT BE MIGRATED ON TO ESA OR ANY OTHER BENEFIT "AFTER A MEDICAL " IT ALL READS CONFUSEING TO ME, I ONLY HOPE THAT I AM IN THE CLEAR .

    Nice short answer yes you are fortunate and will not be re-assessed under the migration to ESA and may in fact already be able to claim Pension Credit instead of IB if doing so would be to your advantage.

    To check if that is the case talk to JobCentre+ and ask them to do a "better off" calculation for you and also explain how this all works if you are still confused.

    And if what they say doesn't mak e sense come back here and we will help you to help them to help you if that makes sense. LOL

    wow peter thankyou for the quick reply, it was what i wanted to hear,after all the years of uneccesary worry through different governments , do you think that i would be financially better off by going to the jobseekers for advice ? am i right in thinking that if you have more than £16,000 in savings ?, that you would not recieve pension credit , also once you reach 65 whereas you used to be entitled to the higher benefit of the two eg IB OR PENSION the new rule now is that you have not got the choice any longer , you have to go on the pension automatically compareing my I B against the weekly pension ammount , if thats the case i will lose out substantally as my IB is more value ? look thankyou again for the quick response , i am going to have a celebration drink now, has my luck changed now ?, i hope so.

    The key part of my earlier reply is the way having savings over £16,000 doesn't bar one from getting help via Pension Credit so yes having savings over £16,000 will not prevent you claiming Pension Credit.

    It would stop you getting JSA or means tested ESA which is why for many having reached 60 makes Pension Credit the better way to go for many even if the way capital and saving is treated isn't a factor.

    As always the specific advice of what is likely to work best for you will depend on all your circumstances which include personal details it would not be wise to share on a public website which is why I recomend you seek 1-2-1 advice either from JC+ or perhaps someone loke CAB as they would have access to all the relevant information needed to be able to give specific advice for your specific circumstances.

    Hope that clarifies my earlier post for you and please have one for me as I can't drink on the cocktail of meds I'm on. LOL

    I am currently 58 and my retirement year is 2014. I am on Higher rate of DLA and middle rate care, receive IB and IS. MY IB letter said I would come up for 'normal review' in February 2014. My DLA is paid from 30/5/09 to 29/4/2012. Does this mean I will have a review of my DLA after this date and what will this entail?

    They have called me for WFI twice and when I called the DWP they said they information did not come from them as they would not be informing the RBLI (they do the WFI's) they say they did, however, I did go and when i said to the very young man that this was a tick boxing exercise he agreed. He assured me that I would not be called again.

    Your DLA renewal forms should come through as normal about 6 months before the due date and having had your entitlement to DLA reviewed so close to the date the proposed "New" assessment will be introduced in 2014 should mean your claim would be amoung the many passported through without having to be fully re-assessed via forms and/or a medical unless the award in 2012 is deliberately set for review at that time which may be how they will do things.

    As for the rest re Pension Credit et al the same applies to you as I said to others earlier and it might pay to get someone to do a "better off" calculation for you to ensure you are getting the right combination of benefits for your given circumstances.

    Unfortunately until the full details of just how they intend to re-assess us all for DLA and what the criteria will be and who gets re-assessed are finally announced it is, of course, only possible to make (hopefully) informed guesses as to what eactly will happen at that time.

    Thank you Peter, that clarifies it for me. It took a year to get my DLA and dread having to do all this again especially as it will probably get more difficult, however I have a very good Benefit Advisor attached to my HA.
