    Another question about transfer to ESA

    I have just spoken to my sister who tells me that a customer in one of her shops, has a husband on incapacity benefit, he suffers from arthritis.He had an IB medical in feb. of last year and was given a review date in 5 years i.e in mid 2015.I have no reason to believe this is not correct.The person on ib is only in his forties, so not near retirement, he does not live in my area.

    As all the transfers to esa will have been completed by then, or so the government tells us, how can this be right, or is this another question with no answer? i realise they can change review dates but why bother?

    A friend of my family was given a review date, a couple of years ago, that took him well beyond retirement age i certainly am!!

    I have since discovered, before writing my latest thread, that the customers husband was not given a 5 year review time, he just assumed he had been, as this is what happened last time!! he even managed to throw the letter away so he can not check.

    He can check his review date by ringing & asking IB.

    When we are transferred from IB to ESA and we fail the ECA, I assume we lodge an appeal.

    My question is,
    are we still paid while waiting on the appeal decision and if the case goes to Tribunal?

    You should be able to claim the assessment rate of ESA while appealing.

    I have never had a medicalso does that mean I'm exempt? I have been on IB for 6 years now and I believe scored 75 points on the assessment form.

    Most people on ib will be reassed, although they may not have a medical, read the other recent threads, there is loads of info and links on here regarding exempt people, and the transfer plans, i myself said my husband went 9 years without a medical, but was never exempt ,as he is now due for a medical, Jan

    Assessments done now, unless you are in a pilot area, are under IB rules for IB claims. the review date will have been given because it was appropriate. It will not stop an earlier review as appropriate.

    Until things change assessments must be carried out under the regs in force

    I do not know if this reply is for me as the op, but if it is, as you will see from my other threads, my husband is being reviewed at the moment, as you say, under the old rules, i.e he filled in an ib5o last april, and has just been called for a medical. The original point i was trying to make was do these review times now mean nothing? after trying on another thread, i have been unable to find someone who has recently had an ib medical and been given a review date.DO they still give them so near to the transfers?

    If my husband has the ib medical next week and is given the same review time as his last one, which was 3 years, based on the fact that review times were supposed to be, when the transfers to esa were done, will this still be the case or will they simply ignore this date and pick out people at random? does anyone really know? as so many opinions about older/younger/long term ib claimants/exempt people being tested first, are being bandied about.

    I know all the facts about the transfers, it is when they will carry them out, on a personal level i mean, not the whole transfer process timescale.I am editing to add that we seem to be discussing things on several threads and once again, thank you for your info, given or to be given, Janet
