    Unhappy full DLA to PIP with nothing plz help

    I suffer with mental health and social anxiety cant go out without my partner and have a massive fear of public transport, I have neuropathic pain syndrome, in my right ankle and have serve problems with my right shoulder with whom im under a specialist at the hospital for. i was told today by the PIP people that my 1st refusal and the my maderty reconsideration was only 9 days apart and now they have sent my paper work to a tribunal. without me having any time to send further evidence and also they made the 2nd decision without even having my letter which was put on the system 10 days after they had made the 2nd decision. im totally confused and they are going to ring me back within 5 days, any help would much be appreciated. I was on full DLA higher rate mobility and middle rate care for the past 5 years + then told by PIP that i wasnt entitled to nothing........... i only scored 4 points on mobility side and 4 points on daily living part.......dont know what to do know, my home visit from DWP was only 25 mins not 90 like most peoples she said i did things while she observed but i didnt do any think like she had put in her report, asked me if i owned a microwave, which i said yes too.......then in her report said i was able to cook and manage buy myself whilst my husband was out of the room. plus said i was able to chop mushrooms.............dont even like mushrooms, i adjusted my glasses on my face with my right arm, she put in her report i touched my head with both arms and was able to bathe and wash my own hair, she never asked me about dressing or undressing but apprently i can do all this by myself also...........its a joke if you ask me, never once asked about my mental health problems. what cam i do?

    Well I had got 7 for daily living and 4 for mobility, the same after the MR. This meant I had a choice, a tribunal or reapply for PIP. I decided to reapply for PIP as this allowed to me to write a lot more detailed description with my PIP2 form (which both decision makers for previous PIP claim based my points on), and to provide evidence that I couldn't get hold off previously. It seems this time because I was more thoroughly detailed with my problems and how they affected me as well as provide a more detailed report from my GP, a hospital doctor and my social worker, that they (Atos) had enough infomation and evidence to write a report without a F2F assessment, which I had to wait a year for in my previous claim. My advice is to think about which would be easier for you a tribunal, or reapplication for PIP. Remember that reapplication for PIP will mean you lose the backpay. You could go to a tribunal where you could still get the backpayment, but you will need to print the paperwork requesting a tribunal online, fill the form and send it to the address stated on the form. Either way you could do what I have done and that is to write or type the descriptors down and under each one write the problems you have with each and/or how these problems have put you in a bad situation. I have found that the only problems that are focussed on are ones that affect your ability to do the descriptors, anything else is pretty much ignored, even if it does have an impact on you, but knowing this is good because it means regardless of reapplying for PIP or going to the tribunal, you can make a detailed report of how your conditions affect your ability to carry out these tasks mentioned in the descriptors.

    thank you chrisAllen for you help so i can cancel appeal and put in a fresh claim with pip?but when i send form off send all gp,hospital reports and mental health letters also? thanks in advance its just this is all so confusing

    Yes you can cancel the appeal and start a new claim, of course you WILL NOT get the backpayment from the current claim though. If you decide to go ahead with a new claim then my advice is to give a basic account of your problems under each descriptor on the PIP2 (how your disability affects you) form, then write or type all the descriptors on computer or paper and put a full description under each descriptor of your problems and how you are unable or struggle to carry out the task. Make sure to include situations where carrying out any of the tasks gives you stress, pain or if you are have placed yourself in a vulnerable or dangerous position as a result of your medical conditions. Also don't be reluctant to include other medical infomation even if you feel that it won't get you any points, for example because I was born with permenant kidney damage, I need to be to able use the toilet when needed or otherwise my damaged kidney can easily get infected causing more damage and severe pain, now while I don't expect to receive any points for that, I did still put it in the managing toilet needs and incontinence descriptor. The best thing to do is to basically paint a picture of how all your medical conditions affect you. Once you have done all that include the full detailed paper of your medical conditions with as much evidence as possible from GPs, hospital reports, social workers, healthcare workers, support workers, etc. If you are lucky they may also use evidence from the first PIP claim, at least I believe that is what they have done for me, and if you have made a detailed enough report then you may even avoid a face to face assessment, I have so it is not impossible.     I have a new claim and I have a tribunal hearing at the same time due in 2 weeks.
