    I have received the usual let saying it will be paid first week in December - still waiting!

    I got my Carers bonus at the beginning of December, but like some of you, my hubby has had no bonus this year.

    From what's been said on another forum, it appears the DWP messed up and many of us received double last year - £10 on ESA & £10 on DLA, so they're having it back of us this year.

    The same thing has happened to me. As far as I can work out, they have removed the eligibility by ESA except for contribution related which is time limited. I am in the Support Group which but this doesn't seem to make any difference. According to the DWP website, we should qualify due to DLA. I e-mailed the DLA office and their reply was that, as ESA is a higher ranking benefit, it is paid from there and I should contact them. I have sent them an e-mail but have not yet received a reply. As usual, one hand doesn't seem to know what the other is doing! The words P**s-up and brewery come to mind!
    If the politicians have taken such a mean, penny-pinching action of taking a £10 Christmas bonus away from disabled people, whilst awarding themselves a huge pay increase, it really makes me wonder what kind of people are in this Government. How do they sleep at night!

    You need to point the decision maker to section 150 of the Social Security Contributions and Benefits Act 1992 as amended by the Welfare Reform Act 2007. Unfortunately, I'm not any free sources online that carry this heavily amended piece of legislation in its fully amended form.

    Section 150 of the 1992 Act defines a qualifying benefits for Christmas Bonus as including contributions related ESA (WRAG and Support Group only, not those in the assessment phase), DLA and PIP. Income related ESA has never been a qualifying benefit for Christmas Bonus.


    There is a change in the Welfare Reform Act 2012 to extend Christmas Bonus to all ESA recipients in the WRAG and Support Groups. This is found in section 33(3) and schedule 3 of the Welfare Reform Act 2012, which amends section 150(2) of the Social Security Contributions and Benefits Act 1992, changing the words "a contributory allowance" in the definition of "a qualifying employment and support allowance" to "an employment and support allowance". This provision has not yet to be brought into effect.

    I wonder if there's a "left hand doesn't know what right hand is doing" thing going on here: the DLA people believe that the extension to income related ESA has taken place but the ESA people know it has not.


    Get back on to the DLA people, tell them that the Welfare Reform Act 2012 change extending Christmas Bonus to income related ESA has not been brought into effect yet, and ask for your £10. Good luck.

    I have just seen on the news that 32,000 people did not recieve their benefits in time for Christmas. This was due to an "admin error". Absolutely disgusting. I bet the people who were supposed to action the benefits for the 32,000 got their salary on time!!!

    My original query to the DLA office received the reply that I should contact ESA. My query to ESA received no reply so I have now gone back to DLA and put your points to them regarding the extension to the qualifying ESA criteria. If they agree with your interpretation, many of us should receive a belated Christmas Bonus. It would still mean that, for 2013 at least, some ESA recipients will have had this small gesture of goodwill taken away from them. How mean is that!

    I should like to thank you for finding details of these amendments.

    Joy to the World! I've finally got my Christmas bonus. I have been chasing this since December and received a letter this morning (3rd Feb) that £10 is being paid into my account. If you didn't receive yours, I would recommend chasing it. Now what should I spend it all on? Bob

    That's great news - thanks for getting back to us.

    Did you have to get too detailed about the law with DWP, or just insist to the DLA office that they should be paying the £10 Christmas Bonus?
